MyDrinkCreation™ is an independent digital education platform dedicated to drink design, food and beverage creativity, modern techniques, hospitality, gastronomy and creative development.

These Terms & Conditions explain the rules that apply when you access our Website, create an account, purchase a course or membership, or otherwise use our products and services.

Throughout these Terms, “MyDrinkCreation”, “MyDrink”, “we”, “our” and “us” refer to MyDrinkCreation and its operator. “You” and “your” refer to the person accessing or purchasing from our Website.

By accessing, purchasing from or using MyDrinkCreation.com, you agree to these Terms.

Please read them carefully.

1. Acceptance of Terms

By using our Website, creating an account, purchasing a product or accessing our Services, you agree to comply with these Terms.

If you do not agree with these Terms, you should not purchase or continue using our Services.

These Terms should be read together with any additional information presented at checkout, our Privacy Policy, and any specific terms clearly displayed for a particular product or promotion.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot legally be excluded, including rights available under the Australian Consumer Law and other mandatory consumer laws that may apply to you.

2. Our Services

MyDrinkCreation provides digital educational products and creative resources relating primarily to:

• food and beverage creativity;

• recipes and formulation;

• modern culinary and beverage techniques;

• fermentation, clarification, carbonation and preservation;

• creative exercises, tools and frameworks;

• individual online courses;

• memberships, including Pro Studio; and

• other digital educational products that may be introduced in the future.

Our content is designed for education, professional development, experimentation and creative inspiration.

MyDrinkCreation does not provide legal, medical, financial, accounting or other regulated professional advice.

3. Eligibility and Responsible Use

You must be legally capable of entering into a contract in your jurisdiction to make a purchase from MyDrinkCreation.

Certain content may relate to alcoholic beverages, professional hospitality environments or techniques requiring adult supervision or professional judgement.

You are responsible for complying with the legal drinking age, alcohol service laws, workplace rules and other applicable laws in your location.

Our educational content does not encourage irresponsible or illegal alcohol consumption.

4. Accounts

Some Services require you to create an account.

When creating or using an account, you agree to:

• provide accurate and reasonably up to date information;

• maintain the confidentiality of your login credentials;

• not share your account with another person;

• not sell, transfer or commercially distribute access to your account;

• notify us if you reasonably believe your account has been accessed without permission; and

• use your account only for its intended personal or professional educational purpose.

You are responsible for activity conducted through your account where that activity results from your failure to reasonably protect your login credentials.

5. Personal Access Only

Unless we expressly agree otherwise in writing, a purchase provides access for one individual person only.

A course or Pro Studio membership cannot be shared between employees, colleagues, friends, venues, companies, agencies, schools or other organisations using a single account.

If a business, team, educational institution or organisation requires access for multiple people, please contact us to discuss suitable access.

Sharing login credentials, reselling access or systematically allowing other people to use your account may result in suspension or termination.

6. Prices, Payments and Currency

Prices are displayed before you complete your purchase.

MyDrinkCreation normally displays prices in EUR, euro, unless another currency is clearly specified.

The currency and amount displayed during checkout are the basis of your purchase.

Depending on your location, applicable taxes may be included in or displayed as part of the final price where required by law.

Your bank, card issuer or payment provider may separately apply currency conversion rates, international transaction fees or other charges. These charges are controlled by your financial institution or payment provider, not by MyDrinkCreation.

Payments are processed through third party payment providers.

By completing a purchase, you confirm that you are authorised to use the payment method provided.

We do not directly store complete payment card details where payment processing is handled by our payment provider.

7. Access Period

Unless clearly stated otherwise at the time of purchase, paid MyDrinkCreation courses, memberships and other subscription based educational products provide access for the period shown during checkout.

Where a product is sold as a 12 month or annual subscription, your initial purchase provides 12 months of access from the beginning of your paid subscription period.

Purchasing access does not transfer ownership of the course, materials or intellectual property to you.

You receive a limited, personal, non exclusive and non transferable licence to access and use the relevant educational content during your active access period.

8. Automatic Renewal

Where a product is clearly described during purchase as an annual subscription or automatically renewing product, your subscription will automatically renew at the end of each subscription period unless you cancel it before the next renewal is processed.

This may apply to products including Pro Studio and individual courses where they are offered on an annual recurring basis.

Before you purchase an automatically renewing subscription, we will make available relevant information about the subscription, including its price, subscription period and recurring nature.

When your subscription renews, the applicable renewal payment will be charged to the payment method associated with your subscription.

Unless clearly stated otherwise, each annual renewal provides a new 12 month access period.

If the renewal price changes, we will provide information about the new price where required before it applies.

9. Your Responsibility to Manage Your Subscription

We believe strongly in transparent purchasing and responsible subscription management.

We respect where you choose to invest your money, and in return we ask you to take reasonable responsibility for the subscriptions you choose to maintain.

You may cancel an automatically renewing subscription before its next renewal date to prevent the next renewal charge.

Your subscription does not automatically end simply because you have stopped using the course, stopped visiting the Website, completed the course, forgotten about your subscription or no longer wish to use the content.

Unless required by law, forgetting to cancel is not by itself grounds for a refund.

We may send courtesy renewal communications or reminders, and where applicable law requires a particular notification we will comply with that requirement.

However, where a reminder is provided only as a courtesy, failure to read, notice or receive that courtesy communication does not itself cancel your subscription or create an automatic entitlement to a refund.

It remains important to keep your email address and account information current.

10. Cancelling a Subscription

You may cancel an automatically renewing subscription at any time before its next renewal.

Where an online cancellation function is available for your subscription, you may use that method to cancel.

You may also contact us for support if you are experiencing a genuine problem managing your subscription.

Cancellation stops future renewal charges.

Unless otherwise stated or required by law, cancelling does not immediately terminate the access period that you have already paid for. You may continue accessing the applicable content until the end of your current paid period.

After that date, access to subscription content may end unless you subscribe again.

Cancellation after a renewal has already been processed normally applies to the following renewal, rather than reversing the subscription period that has already begun, subject always to any rights you have under applicable consumer law.

11. Renewal Refunds

An annual renewal is a new paid access period under the subscription you previously agreed to.

Where the recurring nature, price and subscription conditions were properly disclosed, we do not ordinarily provide a refund solely because:

• you forgot to cancel before renewal;

• you intended to cancel but did not complete the cancellation;

• you did not use the course during the previous subscription period;

• you have not yet used the renewed access;

• you no longer wish to continue;

• you assumed the subscription would end automatically;

• you did not read a courtesy renewal reminder; or

• you changed your mind after the renewal was processed.

We believe this is fair to members who consciously maintain and renew their access and fair to the creative professionals whose work supports the platform.

However, this policy does not remove any legal rights that cannot be excluded.

If you believe you were charged incorrectly, charged more than once, charged after a valid cancellation, provided with materially misleading subscription information, or otherwise legally entitled to a remedy, contact us and we will review the situation fairly.

12. General Refund Policy

MyDrinkCreation is a digital education platform.

Our courses contain original lessons, some videos, recipes, methods, frameworks, graphics, photographs and educational materials that can generally be accessed immediately after purchase.

For this reason, except where required by law or expressly agreed by us, we do not ordinarily provide refunds solely for:

• change of mind;

• deciding that you personally do not like the course;

• deciding that the content does not suit your personal taste;

• purchasing without reviewing the available course description or curriculum;

• not watching or completing the course;

• lack of personal use;

• expecting material, outcomes or features that MyDrinkCreation did not represent as being included; or

• changing your personal or professional circumstances after purchase.

Purchasing based on an assumption that is inconsistent with the information reasonably available before purchase does not automatically create a refund entitlement.

We encourage you to read the product description, course information, curriculum and available previews before purchasing.

13. When a Refund or Other Remedy May Apply

We will consider appropriate remedies where circumstances reasonably justify them, including:

• accidental duplicate payments;

• an incorrect product being supplied;

• a material technical access problem directly caused by our systems that we cannot reasonably resolve;

• a payment being processed after a properly completed cancellation where it should not have been processed;

• a Service being materially different from how it was represented at the time of purchase; or

• another circumstance where applicable consumer law requires a remedy.

Depending on the circumstances and applicable law, an appropriate remedy may include correcting access, repairing the issue, replacement, account credit or refund.

Nothing in our Refund Policy excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot legally be excluded.

14. Failed Payments

If a subscription payment fails, our payment provider may attempt to process the payment again.

Access may be limited or suspended while a payment remains outstanding.

We are not responsible for fees charged independently by your bank or payment provider as a result of a declined or failed payment.

15. Promotions and Discounted Prices

From time to time we may offer promotional prices, discount codes or special access conditions.

Unless clearly stated otherwise, a promotional price applies only according to the conditions of that promotion.

A discounted initial purchase does not necessarily mean that future renewals will occur at the same discounted price.

The price and renewal conditions presented to you when purchasing the relevant offer will apply, subject to any later price changes communicated in accordance with applicable law.

Promotional codes have no cash value and cannot normally be applied retrospectively to purchases already completed.

16. Intellectual Property

MyDrinkCreation is built through the work of professional creatives, designers, artists and people working across hospitality, food, drink, photography, video, education and related creative industries.

We take the protection of that work seriously.

Unless otherwise identified, the original content made available through MyDrinkCreation is owned by, licensed to, or used with permission by MyDrinkCreation and its respective creators.

This may include:

• written lessons;

• course structures;

• educational frameworks;

• photographs;

• illustrations;

• graphics;

• videos;

• voiceovers and audio;

• recipes and recipe presentations;

• downloadable documents;

• diagrams and tables;

• visual systems;

• branding;

• logos;

• original educational presentations; and

• other creative materials.

Copyright, trademark and other intellectual property laws may protect this material.

Purchasing a product provides permission to access and use it under these Terms. It does not transfer ownership of the content or underlying intellectual property to you.

17. Using What You Learn Professionally

Our purpose is to help you become more creative.

We want you to use the knowledge, principles and techniques you learn through MyDrinkCreation.

You are welcome to apply what you learn when creating your own:

• drinks;

• menus;

• recipes;

• restaurant or bar concepts;

• food and beverage projects;

• creative experiments;

• hospitality services; and

• original professional work.

Learning from a technique and creating your own original work is different from copying, redistributing or reselling our educational materials.

Your own creativity is encouraged.

Copying our platform is not.

18. What You May Not Do With Our Content

Unless you have our written permission, you may not:

• copy or republish our lessons;

• reproduce substantial parts of our educational materials;

• redistribute course videos or downloads;

• screen record or systematically record paid course content for redistribution;

• upload our paid content to another website or platform;

• sell, sublicense or commercially redistribute our materials;

• share course files with people who have not purchased access;

• reproduce our course structure as a competing educational product using substantially copied material;

• remove copyright, attribution or ownership notices;

• falsely present MyDrinkCreation content as your own;

• use another person’s account to avoid purchasing access;

• systematically download or extract our Website or course library;

• use bots, crawlers, automated scripts or scraping software to collect our content;

• build datasets from our protected content without permission;

• use our protected course materials to train, fine tune, evaluate or develop artificial intelligence or machine learning systems without written permission; or

• attempt to bypass technological, account or payment restrictions used to protect our Services.

19. Automation, Scraping and Artificial Intelligence Systems

MyDrinkCreation is a human led creative education platform.

Our courses are created through professional creative practice, research, design, experimentation, production and industry experience.

We actively protect this work from automated exploitation.

Automated access intended to scrape, duplicate, extract, reproduce, train on or systematically process our protected content is prohibited unless we have given written permission.

We may restrict or block automated systems, accounts, IP addresses or other access where we reasonably believe they are being used to scrape, attack, copy, overload, exploit or interfere with our platform.

20. Professional Conduct and Platform Integrity

We want MyDrinkCreation to remain a useful environment for people who genuinely care about creativity, food, drink, design and hospitality.

Questions, disagreement, feedback and constructive criticism are welcome.

We do not expect everyone to agree with every creative choice, method or opinion presented through our platform.

However, we may take action where conduct moves beyond legitimate criticism and becomes abusive, fraudulent, malicious or disruptive.

Prohibited conduct may include:

• harassment or threats toward our team, collaborators or community;

• repeated abusive communications;

• deliberate spam;

• impersonation;

• fraudulent activity;

• attempts to compromise our Website or accounts;

• attempts to obtain content without paying for required access;

• coordinated attempts to disrupt our Services;

Serious conduct may result in immediate suspension.

Where appropriate and reasonably possible, we may contact the account holder before permanently terminating access.

A genuine negative review, professional disagreement or criticism by itself will not result in account termination.

Our purpose is to protect the platform from abuse, not to prevent honest discussion.

21. Suspension and Termination

We may suspend, restrict or terminate access where reasonably necessary because:

• you materially breach these Terms;

• you share or resell access;

• payment remains legitimately unpaid;

• you seriously misuse our content;

• you attempt to compromise our Website;

• you engage in fraud;

• you engage in serious abusive or threatening behaviour;

• you systematically scrape or reproduce our content;

• we are legally required to restrict access; or

• another serious platform security or integrity risk exists.

Where access is terminated because of a serious breach by you, a refund will not automatically be provided, except where required by law.

Termination does not remove obligations relating to intellectual property, confidentiality, outstanding payments or other provisions intended to continue after termination.

22. User Content

You may occasionally submit or send us photographs, videos, reviews, comments, recipes, feedback or other material, referred to in these Terms as “User Content”.

You confirm that you own the content you submit or have the necessary permission to submit it.

You must not knowingly submit material that unlawfully infringes another person’s rights.

Where you specifically submit User Content to MyDrinkCreation for publication, featuring, reposting, testimonial use or promotional use, you grant us a non exclusive permission to reproduce, display and share that content for those purposes.

You continue to own your original User Content.

Where appropriate, we aim to provide reasonable creator attribution when showcasing substantial creative work, although platform limitations may occasionally affect how attribution is displayed.

23. Reviews and Feedback

We welcome genuine feedback.

If you provide suggestions, ideas or general feedback about improving MyDrinkCreation, you understand that we may use that general feedback to improve our Services without creating an obligation to compensate you.

This does not transfer ownership of your separately created original works, photographs, recipes or other protected creative material to us.

24. Educational Results

MyDrinkCreation provides education, not guaranteed outcomes.

Creativity, professional development and hospitality results depend on many factors outside our control.

We do not guarantee that completing a course will result in:

• employment;

• increased income;

• business growth;

• awards;

• social media growth;

• professional recognition;

• a particular creative result; or

• any other specific commercial outcome.

Examples shown through our courses demonstrate concepts and possibilities, not guaranteed individual results.

25. Recipes, Techniques and Experimental Results

Food and drink development is affected by ingredients, environment, equipment and execution.

Results may vary because of factors including:

• ingredient composition;

• brands and suppliers;

• water chemistry;

• temperature;

• humidity;

• equipment;

• hygiene;

• storage;

• pressure;

• processing time;

• packaging;

• measurement accuracy;

• local ingredients; and

• individual technique.

A recipe or method should therefore be understood as an educational framework that may require professional judgement and adjustment.

Measurements, expected yields and technical targets are provided as accurately as reasonably possible, but normal variation can occur.

26. Food Safety, Preservation and Shelf Life

27. Equipment, Heat, Pressure and Technical Safety

Any ABV calculation or estimate provided by MyDrinkCreation should be treated according to the context in which it is presented.

Where legally accurate alcohol labelling, taxation, manufacturing compliance or commercial product specifications are required, appropriate professional measurement and regulatory advice may be necessary.

You remain responsible for complying with local alcohol production, sale, service and consumption laws.

A subscription provides access to the applicable Service during your active access period. It does not guarantee that every individual lesson, feature or piece of content will remain permanently identical.

Where possible, significant changes will be made with the intention of maintaining or improving the overall educational value of the relevant Service.

We do not promise lifetime access unless a product is expressly sold using those words.

31. Technical Requirements

You are responsible for having suitable technology to access digital content.
